Terms of Service

These Terms of Service (“Terms”) govern your use of Field.is, a practice management platform operated by Field.is LLC (“Field,” “we,” “us”). By creating an account or using our services, you agree to these Terms.

1. Definitions

Operator: A professional who subscribes to Field to manage their practice and client relationships.
Client: An end user of an Operator's services who accesses the Field portal or receives communications generated through Field.
Platform: The Field.is web application, APIs, and associated services.

2. Account Terms

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use Field. One person or legal entity may maintain no more than one Operator account.

3. Operator Responsibilities

Operators are responsible for their own client relationships, pricing decisions, and professional obligations. Field provides tools and infrastructure — it does not provide professional advice, legal guidance, or guarantee any business outcomes.

Operators are responsible for ensuring they have appropriate authorization to submit client communications and third-party data to Field for processing. Field does not independently verify the legal basis for data submitted by Operators. If you submit email content, client communications, or other third-party data to Field, you represent that you have the right to do so.

We reserve the right to suspend or terminate accounts that violate these terms. Where possible, we will provide notice and an opportunity to remedy the violation before suspension.

5. Data Processing Relationship

Field acts as a data processor on behalf of Operators, who act as data controllers for their clients' data. Field processes Operator data exclusively to provide the Platform services. Field does not use Operator data for its own purposes, sell it, or share it with third parties except as necessary to provide the service (see Section 8).

Field stores operator email content and AI-generated assessments on the Operator's behalf as part of the intake triage service. This data is processed using the Operator's configured AI provider credentials.

AI-generated assessments and structured extractions derived from Operator data are stored by Field to provide triage and pipeline services. This derived data remains subject to the same data processor relationship as the source content.

6. AI Processing Disclosure

Field uses artificial intelligence to provide certain features including assessments, report drafting, request parsing, and email triage. Some AI processing uses Field's own API credentials (for platform features like scanning and reports). Other AI features (email triage, inline assessment, command bar) use the Operator's own API credentials configured through the Platform.

When AI features are enabled, data may be transmitted through Field's servers to the Operator's configured AI provider. Operators are responsible for reviewing and understanding their AI provider's terms regarding data processing and retention.

7. Service Availability

Field provides monitoring, triage, and practice management services on a best-efforts basis. We do not guarantee any specific level of uptime, response time, or service availability. While we strive to maintain reliable service, Field is not liable for downtime, delayed alerts, missed notifications, or any business impact resulting from service interruptions.

Field's monitoring and tracking features (uptime checks, scan schedules, SLA tracking, time and budget tracking) are tools to assist the Operator. The Operator remains responsible for their client relationships and professional obligations regardless of Field's service status.

8. Billing and Payment

Operator subscriptions are billed monthly or annually via Stripe. Prices are as listed at the time of subscription. We may change pricing with 30 days' notice.

Founding tier: Founding tier pricing ($29/month) is locked for the lifetime of the account as long as the subscription remains continuously active. If a Founding operator upgrades to Solo or Studio and later downgrades, the Founding rate is not restored — the operator returns to the standard rate for the tier they downgrade to. Voluntary cancellation and re-subscription forfeits Founding status. Involuntary interruptions (payment failures) have a 14-day grace period before Founding status is lost.

Refunds are handled on a case-by-case basis. You may cancel your subscription at any time; service continues until the end of the current billing period.

9. Third-Party Services

Field integrates with third-party services to provide the Platform. These include but are not limited to: Anthropic (AI processing), Stripe (payment processing), Resend (transactional email), Supabase (database and authentication), and Vercel (hosting). Each third-party service is governed by its own terms. Field is not responsible for the practices, availability, or security of third-party services.

10. Limitation of Liability

To the maximum extent permitted by law, Field's total liability for any claim arising from or related to these Terms or the Platform is limited to the total amount you paid to Field in the 12 months preceding the claim.

Field is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of clients, loss of data, or damage to professional reputation, regardless of whether Field was advised of the possibility of such damages.

This limitation applies to all causes of action in the aggregate, including breach of contract, negligence, and any other legal theory.

11. Indemnification

Operators agree to indemnify and hold harmless Field.is LLC, its officers, and agents from any claims, damages, or expenses arising from: (a) the Operator's use of the Platform; (b) the Operator's client relationships; (c) data submitted to Field by the Operator; (d) any violation of these Terms.

12. Dispute Resolution

Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in Johnson County, Kansas.

13. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles.

14. Termination

Either party may terminate the Operator's account at any time. Upon termination, Field will retain Operator data for 60 days to allow for data export, after which it will be permanently deleted in accordance with the data retention schedule described in our Privacy Policy. Billing records are retained for 7 years per tax requirements.

15. Modifications

We may update these Terms from time to time. Material changes will be communicated via email to the address associated with your account at least 14 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance.
